Failure of Milan Srl to demand enforcement of any clause at any given moment shall not vitiate its right to request enforcement thereof at a later date. Should Milan Srl fail to take action in case of a violation of any clause, such failure may not be construed as a waiver of said clause. All waivers by Milan Srl must be in writing. All gists of action with respect to use of the site must be started no later than one year after the arisal of the claim or said gist of action.
If for any reason the place having jurisdiction finds any clause hereof or a part hereof inapplicable, the clause will however be valid up to the maximum admissible so as to reflect the purposes of this contract, and other warranty terms will remain valid and fully applicable. These warranty terms are valid in conformity to Italian law without reference to any conflicting international law.
